GMB Win Court Case For Injured Islington Refuse Worker

£3,500 compensation cost employer £27,500

GMB has taken and won a Clerkenwell County Court case against ICSL Accord and won,£3,500 in personal injury compensation for GMB member Secou Dembele an area driver loader on the refuse contract. The compensation was for an injury to his finger was crushed in the tail lift door at the rear of his works vehicle. The court ordered costs against ICSL Accord in the sum of £24,000. Including the settlement for Mr Dembele of £3,500, mean the case cost ICSL Accord a total of £27,500. 


GMB won the case on all counts, and the employer was found guilty of failing to train the employee and failing to adhere to the workplace equipment PUWER Regulations. The case was handled by GMB's employment right lawyers, Paterson and Brewer's solicitor Victoria Harvey.

 

Gary Doolan, GMB Branch Secretary said, "What amazes me is that this employer simply had to pay our member his rightful compensation of £3.500 which would have avoided the company being found guilty in public and having to pay court costs. They would now be £24,000 richer. GMB will continue to take money from bad employers who place GMB members at risk and cause them injury."
