Glasgow Blacklist Protest Over £45m Contract To BAM

GMB Protest On Tuesday 16th September At Glasgow Constituency Office Of Nicola Sturgeon Over £45m Dundee Contract To Blacklister BAM

Nicola Sturgeon and Alex Salmond should intervene and reverse the decision of Dundee City Council in line with the stated policy of the Scottish Government says GMB.

Paul Kenny, GMB General Secretary, will deliver a letter by hand tomorrow (16th September) to the Glasgow constituency office of Nichola Sturgeon, Deputy First Minister who is responsible for procurement for Scottish Government, during a protest over the SNP led Dundee City Council last Monday naming BAM Construction as the recommended preferred bidder for the £45m tender to build Victoria and Albert (V&A) Museum of Design before BAM has compensated the construction workers it blacklisted.

GMB is requesting that Nicola Sturgeon and First Minister Alex Salmond intervene, and reverse the decision of Dundee City Council in line with the stated policy of the Scottish Government. Contact GMB press office for a copy of the letter

Paul Kenny says in the letter to Nicola Sturgeon“On 9th August 2014 you wrote to Construction Scotland on new guidelines on blacklisting adopted by the Scottish Government. In that letter you said “ This guidance makes it clear that firms which have engaged in blacklisting have committed an act of grave professional misconduct and should be excluded from public procurement, unless they can demonstrate appropriate remedial action”. GMB warmly welcomed your announcement at the time.

The policy of the Scottish Government follows the recommendation of The Scottish Affairs Select Committee that construction firms that blacklisted, or do not make proper reparations for past blacklisting, are denied public contracts unless they undertake a ‘self-cleaning’ process. This includes an admission of guilt, full compensation and other remedial steps for the 582 blacklisted workers in Scotland. Dundee City Council in August last year also adopted this policy as 21 blacklisted workers are from Dundee. See notes to editors for numbers blacklisted by area in Scotland.

The now Dutch owned Royal BAM Group of companies, HBG, BAM Construction, Edmund Nuttall, BAM Nuttall and Higgs & Hill were subscribers to the blacklisting body The Consulting Association (TCA)

In evidence in the High Court it was stated that BAM companies put at least 34 names onto the blacklist and these continued to be blacklisted until the TCA was closed down in 2009. 

Records show that between April 2007 and December 2008 BAM subsidiary Edmund Nuttall name checked 552 potential workers. It is estimated that between 1997 and 2008 around 5,000 names were submitted by Edmund Nuttall to TCA to be checked.

BAM has yet to issue an apology and they haven't paid a single penny in compensation.

As well as seeking to blacklist the blacklisters GMB has begun action in the High Court in London seeking compensation for 122 GMB members blacklisted by a number of firms. GMB’s claims are joined with a further 449 claims by other unions and parties. BAM is one of these firms. The case comes back to the High Court again in November.

Dundee City Council has a statement on blacklisting that is complete lies from BAM. Dundee City Council leader Ken Guild since revealed that the two companies tendering for the contract to build the V&A in Dundee were both blacklisters.

This is a betrayal of blacklisted Scottish workers. All the words about no more public work for blacklisters until they compensate their victims are just words. We are bitterly disappointed. We need you and Alex Salmond to intervene and reverse the decision in Dundee.

If, as has been suggested the Council in Dundee were left with no choice but to award the contract to blacklisters then very serious questions emerge about the whole tendering and scrutiny process.  How did Dundee Council allow itself to be in such a position?

The price of justice of those who have had their lives blighted by these blacklisting companies must be worth more than the small amount of embarrassment a review of this contract would cause those who clearly failed to deal with the history of these bidding companies.

I respectfully ask you to stand up for those workers, who are the real victims, in a spirit of real justice.”
