The Employment Equality (Sex Discrimination) Regulations 2005 SI 2005 No. 2467

 

make amendments to the Sex Discrimination Act 1975 (SDA) and the Equal Pay Act 1970 (EPA) in order to implement the amended Equal Treatment Directive. The amendments only apply to employment and vocational training.

The main changes include:

  • a new definition of indirect sex discrimination;
  • explicit prohibition of harassment and sexual harassment in the SDA;
  • explicit prohibition of discrimination on the ground of pregnancy or maternity leave in the SDA;
  • a new "reasonableness" element to genuine occupational qualification exception allowing employers to refuse to offer a particular job to someone who intends to undergo, is undergoing is has undergone gender reassignment;
  • amendment to the EPA setting out the extent to which it is discriminatory to pay a woman less than she would otherwise have been paid due to pregnancy or maternity issue.

AGE DISCRIMINATION

 

The legislation to ban age discrimination in employment is in force throughout the UK from 1st October 2006 and 1st December 2006 for pension schemes. The legislation (which does not affect the age at which people can claim their state pension) aims to:

  • ban age discrimination in terms of recruitment, promotion and training
  • prevent any forced retirements below age 65 - except where objectively justified
  • remove the upper limit for unfair dismissal and redundancy payments
  • ban the victimisation or harassment of employees on the basis of their age or perceived age.
